Knowledge of the procedures and of the particular requirements of each individual judge in Municipal Court is crucial in criminal defense. Specifically, each local town maintains its own judge who may or may not adhere to the particular procedures outlined under the Rules of Court. Knowledge of individual judges and prosecutors is therefore pivotal. Oftentimes, initial discovery materials sought from the prosecutor, and disclosed, are not the complete set of forms, reports, and evidence that were created in an individual case. We understand the many aspects of each individual case and will make motions, if necessary, in order to press the state to disclose all evidence and reports in your matter.

Further, the investigative experience which John Tierney gleaned during his tenure with the Bronx County, New York District Attorney’s Office is a tremendous asset in your defense. This investigative and trial background, as a former Prosecutor, enables us to evaluate all police reports and evidence in order to frame substantive defenses and attack the constitutional and legal procedure employed by the Police Department. This may include, among many things, analysis of the advisement of rights and specific procedures utilized by the police in their AlcoTest breathalyzer procedure. Further, it may include specific analysis of the patrol car’s videotape and the officers’ radio communications to and from dispatch. Lastly, the necessity to have a competent trial attorney experienced in trial tactics before both judge in Municipal Court and jury, in Superior Court, cannot be over-emphasized. This ability to analyze the evidence and frame a cohesive defense is crucial to any negotiation with the prosecutor as well as in effective direct, cross examination, and argument at trial.
